9th Circuit Backs Government's State Secrets Claim in Rendition Case |

Terror suspects who claim they were tortured abroad at the hands of the U.S. government have lost their latest attempt to sue the private American company they say was involved in their abduction as part of an "extraordinary rendition" program under the Bush administration. The 9th Circuit, in a 6-5 opinion that delves into the scope and application of the state secrets doctrine, issued an en banc opinion finding that such litigation could reveal state secrets and tossed the case. |

Judge Criticizes but Doesn't Kill Major Lindsey's Suit Against Former Recruiter |

Major Lindsey & Africa's racketeering suit against a former recruiter
has survived a motion to dismiss -- barely. Federal Judge Colleen
McMahon threw out Major Lindsey's claims against former managing
director Sharon Mahn under the Computer Fraud and Abuse Act and issued
some stern words regarding the RICO claims. The judge wrote that she had
"ample experience with the assertion of bogus RICO claims" by litigants
seeking to obtain federal jurisdiction or extract a "coercive
settlement" by calling someone a racketeer. |

Law Firms 'Shrinking Toward Profit Growth' in Midyear Survey |

The 2010 midyear data reported by 187 U.S.-headquartered firms to the Law Firm Group at Citi Private Bank may best be described as "shrinking toward profit growth." During the first half of 2010, revenue was virtually flat, and demand was down slightly, compared with the same period in 2009. Inventory grew by less than 1 percent. Given that these results are being compared to a weak first half of 2009, this hardly represents a robust rebound. At best, it may be a bottoming out. |

Nursing Home Company Settles $677 Million Lawsuit for $50 Million |

| |
California nursing home operator Skilled Healthcare Group will pay $50 million to settle a lawsuit that threatened to bankrupt the company after a jury ordered it to pay $677 million for failing to provide enough nurses and staff. The money will go to the roughly 32,000 patients covered by the class action lawsuit as well as cover attorney fees. Once a judge approves the settlement, lawyers representing the patients have agreed to dismiss the verdict, thought to be the largest damages award in the country this year. |
